Worked example
A unit rents for $1,500 a month. The tenant pays the utilities, and the housing authority's utility allowance is $150. The family's adjusted monthly income is $2,000, and its gross monthly income is $2,400. The local payment standard for the unit is $1,600, and the minimum rent is $50. This is the first assisted lease.
| Step | How we get it | Per month |
|---|---|---|
| 1. Gross rent | $1,500 rent + $150 utility allowance | $1,650 |
| 2. Total tenant payment (TTP) | Highest of 30% × $2,000 = $600, 10% × $2,400 = $240, minimum rent $50 | $600 |
| 3. HAP (housing authority) | Lower of $1,600 and $1,650, minus $600 | $1,000 |
| 4. Family share | $1,650 gross rent − $1,000 HAP | $650 |
| 5. Tenant rent to owner | $650 family share − $150 utility allowance | $500 |
| 6. 40% check | $650 family share vs 40% × $2,000 = $800 | Passes |
Result: the housing authority pays the owner $1,000 a month. The tenant pays the owner $500 and pays the utilities. The tenant share includes $50 because the gross rent is above the payment standard. Passes: the family share of $650 is not more than 40% of adjusted income ($800).
Same family, rent $1,900: the gross rent is $2,050 and the HAP stays at $1,000, so the family share is $1,050. That is more than $800, so the unit fails the 40% check at first lease. The highest gross rent that passes is $1,800.
How the Section 8 rent split works
The Section 8 rent split follows HUD rules for the Housing Choice Voucher program. The housing authority computes it in 2 steps (HUD HCV Guidebook, Calculating Rent and HAP Payments):
- At voucher issue. The housing authority sets the family's TTP and its payment standard. The maximum subsidy is the payment standard minus the TTP.
- After the family picks a unit. The housing authority adds the utility allowance to the rent to get the gross rent. Then it computes the HAP, the family share and the 40% check.
Words used here: contract rent is the rent to owner on the lease. The utility allowance is the housing authority's estimate of the utilities the tenant pays. Adjusted income is income after the deductions HUD allows.

Questions
How much does Section 8 pay a landlord?
The housing authority pays the housing assistance payment (HAP). The HAP is the payment standard or the gross rent, whichever is lower, minus the total tenant payment (24 CFR 982.505). The owner gets the HAP up to the contract rent. Any HAP above the contract rent goes to the family or the utility company as a utility reimbursement.
How much does a Section 8 tenant pay?
The tenant pays the total tenant payment (TTP): the highest of 30% of adjusted monthly income, 10% of gross monthly income, or the minimum rent (24 CFR 5.628). If the gross rent is above the payment standard, the tenant also pays the difference. The tenant pays the owner this amount minus the utility allowance.
What is the 40% rule in Section 8?
At the first assisted lease for a unit, the family share may not exceed 40% of adjusted monthly income when the gross rent is above the payment standard (24 CFR 982.508). The rule does not apply when the gross rent is at or below the payment standard. It also does not apply to changes after move-in, such as a rent increase (HUD HCV Guidebook).
What is a payment standard?
The payment standard is the maximum monthly assistance for a family, before the TTP is taken off (24 CFR 982.4, HUD Payment Standards chapter). A housing authority may set it between 90% and 110% of the HUD Fair Market Rent without HUD approval (the basic range). The family's payment standard is the lower of the voucher size and the unit size amount.
What is the minimum rent?
Each housing authority sets a minimum rent from $0 to $50 a month for the voucher program (24 CFR 5.630). A family with a financial hardship can ask for an exemption.
Why can my housing authority's numbers differ from this estimate?
The housing authority verifies income and deductions, checks that the rent is reasonable and uses its own utility allowance schedule. It can also apply welfare rent, prorated assistance or a hardship exemption. This tool leaves those out.
